25 years of the CPT: achievements and areas for improvement

Parliamentary Assembly

1. The Parliamentary Assembly recalls its Resolution 2160 (2017) «25 years of the CPT: achievements and areas for improvement» and reiterates its highest appreciation and support for the work of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT).
2. In its Recommendation 1968 (2011) on strengthening torture prevention mechanisms in Europe, the Assembly invited the Committee of Ministers to place on its agenda and discuss as a matter of urgency the CPT's public statements. In its reply to the Assembly, the Committee of Ministers agreed in principle. But it has failed to place on its agenda the only such statement that the CPT has made since then. The Assembly therefore reiterates the invitation made in that recommendation.
3. Furthermore, the Assembly is concerned about the fragile situation of the secretariat of the CPT due to an inadequate number of staff members employed on a permanent basis, despite the permanent nature of the work. It therefore invites the Committee of Ministers to ensure that the CPT is supported by an adequate secretariat with relevant professional skills and composed of staff members employed on a permanent basis.

Assemblée parlementaire

1. L'Assemblée parlementaire rappelle sa Résolution 2160 (2017) «25 ans du CPT: progrès accomplis et améliorations à apporter», et exprime de nouveau sa très grande considération pour les travaux du Comité européen pour la prévention de la torture et des peines ou traitements inhumains ou dégradants (CPT) et lui réitère son soutien.
2. Dans sa Recommandation 1968 (2011) «Renforcer les mécanismes de prévention de la torture en Europe», l'Assemblée a invité le Comité des Ministres à inscrire à son ordre du jour les déclarations publiques du CPT et à les examiner de toute urgence. Dans sa réponse à l'Assemblée, le Comité des Ministres a donné son accord de principe. Il n'a pas réussi cependant à inscrire à son ordre du jour la seule déclaration que le CPT ait faite depuis lors. L'Assemblée renouvelle donc l'invitation faite dans cette recommandation.
3. En outre, l'Assemblée est préoccupée par la situation précaire du secrétariat du CPT, due à un nombre insuffisant d'agents employés sur une base permanente, en dépit de la nature permanente des travaux du CPT. Elle invite donc le Comité des Ministres à s'assurer que le CPT est aidé par un secrétariat adéquat, avec les compétences professionnelles pertinentes, et composé d'agents employés sur une base permanente.

25 anni di CPT: risultati raggiunti e margini di miglioramenti

1. L'Assemblea parlamentare richiama la sua Risoluzione ... (2017) «25 anni di CPT: risultati e margini di miglioramento» e reitera il più grande apprezzamento e sostegno per l'operato del Comitato europeo per la prevenzione della tortura e delle pene o trattamenti inumani o degradanti (CPT).
2. Nella Raccomandazione 1968 (2011) sul rafforzamento dei meccanismi di prevenzione della tortura in Europa, l'Assemblea ha invitato il Comitato dei Ministri a inserire all'ordine del giorno e discutere con urgenza le dichiarazioni pubbliche del CPT. Nella sua risposta all'Assemblea, il Comitato dei Ministri ha acconsentito in linea di principio. Non è, tuttavia, riuscito a inserire all'ordine del giorno l'unica dichiarazione che il CPT ha fatto da allora. L'Assemblea reitera, pertanto, l'invito formulato nella Raccomandazione 1968 (2011).
3. L'Assemblea esprime, inoltre, preoccupazione per la situazione precaria del Segretariato del CPT dovuta all'insufficienza di personale assunto a tempo indeterminato, malgrado la natura permanente del lavoro del CPT. Invita, pertanto, il Comitato dei Ministri ad assicurare che il CPT sia coadiuvato da un segretariato adeguato, con competenze professionali pertinenti e composto da personale assunto a tempo indeterminato.
