Human rights of older persons and their comprehensive care
Parliamentary Assembly
1. The Parliamentary Assembly refers to its Resolution 2168 (2017) on human rights of older persons and their comprehensive care.
2. The Assembly welcomes the recent work of the Committee of Ministers in this field, resulting in the adoption of Recommendation CM/Rec(2014)2 on the promotion of human rights of older persons, which is a comprehensive instrument and a far-reaching statement on the rights of older persons.
3. The Assembly notes that other regional organisations promoting human rights have recently opted for a legally binding instrument devoted to the rights of older persons, for example the Inter-American Convention on Protecting the Human Rights of Older Persons and the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa.
4. In the light of the foregoing, the Assembly recommends that the Committee of Ministers:
4.1. thoroughly examine the implementation of Recommendation CM/ Rec(2014)2 by, inter alia, closely involving civil society and all other relevant stakeholders in the process;
4.2. based on the conclusions drawn from this exercise, consider the necessity and feasibility of drawing up a legally binding instrument in this field;
4.3. urge those member States which have not yet done so to sign and ratify the European Social Charter (revised) (ETS No. 163) and accept, in particular, its Article 23 on the right of elderly persons to social protection.

Les droits humains des personnes âgées et leur prise en charge intégrale
Assemblée parlementaire
1. 1.L'Assemblée parlementaire renvoie à sa Résolution 2168 (2017) sur les droits humains des personnes âgées et leur prise en charge intégrale.
2. L'Assemblée salue les travaux récents du Comité des Ministres dans ce domaine, qui ont abouti à l'adoption de la Recommandation CM/Rec(2014)2 sur la promotion des droits de l'homme des personnes âgées; il s'agit d'un instrument complet et d'une déclaration ambitieuse sur les droits des personnes âgées.
3. L'Assemblée note que d'autres organisations régionales de promotion des droits humains ont récemment opté pour un instrument juridiquement contraignant consacré aux droits des personnes âgées, par exemple la Convention interaméricaine sur la protection des droits de l'homme des personnes âgées et le Protocole à la Charte africaine des droits de l'homme et des peuples relatif aux droits des personnes âgées en Afrique.
4. Au vu de ce qui précède, l'Assemblée recommande au Comité des Ministres:
4.1. d'examiner de manière approfondie la mise en œuvre de la Recommandation CM/Rec(2014)2, notamment en associant étroitement à ce processus la société civile et tous les autres acteurs concernés;
4.2. d’évaluer, sur la base des conclusions tirées de cet exercice, s'il est nécessaire et envisageable d’élaborer un instrument juridiquement contraignant dans ce domaine;
4.3. d'appeler instamment les États membres qui ne l'ont pas encore fait à signer et à ratifier la Charte sociale européenne (révisée) (STE no 163), et à accepter, en particulier, son article 23, relatif aux droits des personnes âgées à la protection sociale.

Diritti umani degli anziani e assistenza integrale
Assemblea parlamentare
1. L'Assemblea parlamentare fa riferimento alla propria Risoluzione 2168 (2017) sui diritti umani degli anziani e l'assistenza integrale.
2. L'Assemblea esprime soddisfazione per l'attività recente del Comitato dei Ministri, che si è conclusa con l'adozione della Raccomandazione CM/Rec(2014)2 sulla promozione dei diritti umani degli anziani; si tratta di uno strumento completo e di una dichiarazione ambiziosa sui diritti umani degli anziani.
3. L'Assemblea osserva che altre organizzazioni regionali che sostengono i diritti umani hanno recentemente optato per uno strumento giuridico vincolante consacrato ai diritti degli anziani, per esempio la Convenzione interamericana sui diritti delle persone anziane e il Protocollo alla Carta africana dei diritti umani e dei popoli relativo ai diritti delle persone anziane in Africa.
4. Alla luce di quanto precede, l'Assemblea raccomanda al Comitato dei Ministri:
4.1. di esaminare in maniera approfondita l'attuazione della Raccomandazione CM/Rec(2014)2, in particolare coinvolgendo da vicino in questo processo la società civile e tutti gli altri attori coinvolti;
4.2. di valutare, sulla base delle conclusioni tratte da questo esercizio, se sia necessario e opportuno elaborare uno strumento giuridicamente vincolante in questo campo;
4.3. di esortare gli Stati membri che non lo abbiano ancora fatto a firmare e ratificare la Carta sociale europea (rivista) (STE n° 163), e accettare, in particolare, l'articolo 23, sui diritti degli anziani alla protezione sociale.
