The situation in Libya: prospects and role of the Council of Europe
Parliamentary Assembly,
1. The Parliamentary Assembly refers to its Resolution 2215 (2018) «The situation in Libya – prospects and the role of the Council of Europe».
2. Being aware that only the establishment of unified state structures will help to end widespread and daily violations of human rights and humanitarian law in Libya and will be able to lastingly reduce the terrorist threat and stem migration flows, which are realities affecting the member States directly, the Assembly considers that the Council of Europe has good reason to contribute to the efforts of the United Nations Support Mission in Libya to this end, bearing in mind its expertise in institutional matters and the objectives set by the Special Representative of the United Nations Secretary-General for Libya in his Action Plan of 20 September 2017.
3. Noting that the establishment of this co-operation organised on an ad hoc basis could partly be carried out within a regional framework by favouring the opening of targeted programmes, currently covering countries like Tunisia, to representatives of the administrations of the Libyan Government of National Accord, the Assembly, subject to the Libyan authorities’ request, requests the Committee of Ministers to be ready to assist in a timely manner in:
3.1. the establishment of criteria for monitoring the respect for human rights of migrants in Libya and in Libyan territorial waters based on the relevant conventions and in particular on the European Convention on Human Rights (ETS No. 5) and its case law;
3.2. the establishment of electoral assistance in preparation for a constitutional referendum and then for parliamentary and presidential elections;
3.3. the creation of a media environment capable of reporting on the above elections, working as much as possible in line with international ethical standards for journalists.

La situation en Libye: perspectives et rôle du Conseil de l'Europe
Assemblée parlementaire,
1. L'Assemblée parlementaire se réfère à sa Résolution 2215 (2018) «La situation en Libye: perspectives et rôle du Conseil de l'Europe».
2. Consciente que seule la création de structures étatiques unifiées permettra la fin des violations massives et quotidiennes des droits de l'homme et du droit humanitaire en Libye et sera à même de réduire la menace terroriste de manière pérenne et d'endiguer les flux migratoires, réalités qui affectent directement ses États membres, l'Assemblée considère que le Conseil de l'Europe serait légitimé à contribuer aux efforts de la Mission d'appui des Nations Unies en Libye en ce sens, compte tenu de son expertise dans le domaine institutionnel et des objectifs fixés par le Représentant Spécial du Secrétaire général des Nations Unies pour la Libye dans son Plan d'action du 20 septembre 2017.
3. Notant que la mise en place de cette coopération organisée sur une base ad hoc pourrait en partie s'effectuer dans un cadre régional en favorisant l'ouverture de programmes ciblés actuellement dédiés à des pays comme la Tunisie, à des représentants des administrations du gouvernement d'entente nationale libyen, l'Assemblée, sous réserve que les autorités libyennes en expriment la demande, demande au Comité des Ministres d’être prêt à apporter son aide en temps utile:
3.1. à la fixation de critères pour le contrôle du respect des droits de l'homme des migrants en Libye et dans les eaux territoriales libyennes fondés sur les conventions pertinentes et, notamment, sur la Convention européenne des droits de l'homme (STE no 5) et sa jurisprudence;
3.2. à la mise en place d'une assistance électorale en prévision d'un référendum constitutionnel puis d’élections législatives et présidentielle;
3.3. à la création d'un environnement médiatique capable de rendre compte des scrutins ci-dessus, en se rapprochant le plus possible des standards internationaux en matière d’éthique journalistique.

Assemblea parlamentare,
1. L'Assemblea Parlamentare rimanda alla sua Risoluzione 2215 (2018) su «La situazione in Libia: le prospettive e il ruolo del Consiglio d'Europa».
2. Consapevole che solo l'instaurazione di strutture statali unificate contribuirà a porre fine alle violazioni diffuse e quotidiane dei diritti umani e del diritto umanitario in Libia e sarà in grado di ridurre durevolmente la minaccia terroristica e arginare i flussi migratori, realtà queste che investono direttamente gli Stati membri, l'Assemblea ritiene che il Consiglio d'Europa sia legittimato a contribuire agli sforzi della Missione di sostegno delle Nazioni Unite in Libia a tal fine, tenuto conto della propria competenza in materia istituzionale e degli obiettivi fissati dal Rappresentante speciale del Segretario generale delle Nazioni Unite per la Libia nel suo Piano d'azione del 20 settembre 2017.
3. Rilevando che l'istituzione di questa cooperazione organizzata su una base ad hoc potrebbe in parte aver luogo entro un quadro regionale, favorendo l'apertura di programmi mirati, adesso dedicati a paesi come la Tunisia, a rappresentanti delle amministrazioni del Governo di accordo nazionale libico, l'Assemblea, a patto che siano le autorità libiche a farne richiesta, chiede al Comitato dei Ministri di essere pronto a fornire tempestivamente il suo aiuto a:
3.1. la fissazione di criteri sul controllo del rispetto dei diritti umani dei migranti in Libia e nelle acque territoriali libiche fondati sulle convenzioni in materia e, in particolare, sulla Convenzione europea dei diritti dell'uomo (STE no5) e sulla sua giurisprudenza;
3.2. la predisposizione di un'assistenza elettorale in preparazione di un referendum costituzionale e poi di elezioni parlamentari e presidenziali;
3.3. la creazione di un ambiente mediatico in grado di informare sulle elezioni suddette, operando quanto più possibile secondo le norme internazionali di etica giornalistica.
