Ending enforced disappearances on the territory of the Council of Europe

Parliamentary Assembly

1. The Parliamentary Assembly refers to its Resolution 2425 (2022) «Ending enforced disappearances on the territory of the Council of Europe» and stresses how crucially important it is for human rights and the rule of law that fresh impetus be given to international efforts to put an end to enforced disappearances in Europe and elsewhere in the world.
2. With this aim in mind, the Assembly recommends that the Committee of Ministers:

2.1. promote ratification of the United Nations International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED) by all Council of Europe member States and recognition of the full competence of the Committee on Enforced Disappearances, as well as the integration into national legislation of all the preventive and enforcement measures foreseen by the ICPPED;

2.2. provide technical assistance, with the co-operation of the States that are already parties to the ICPPED, to all interested States in order to help them implement the ICPPED, on the basis of an in-depth analysis of the existing legislation of the States concerned;

2.3. set up, within the Council of Europe, a task force on enforced disappearances responsible for co-ordinating the aforementioned activities and monitoring the progress of legal protection against this crime in the Council of Europe's member States as well as improving prevention, with the involvement of civil society;

2.4. pay particular attention to the execution of the judgments of the European Court of Human Rights relating to cases of enforced disappearance and to the implementation of the relevant provisional measures indicated by the European Court of Human Rights;

2.5.

encourage member States to impose sanctions on State bodies, State-controlled groups and individuals that are implicated in cases of enforced disappearance on the territories of the Council of Europe's member States or that are obstructing effective investigation into such cases;

2.6. support the idea of holding a world conference on the topic of enforced disappearances, which would also provide an opportunity for States to announce new ratifications of the ICPPED.

En finir avec les disparitions forcées sur le territoire du Conseil de l'Europe

Assemblée parlementaire

1. L'Assemblée parlementaire se réfère à sa Résolution 2425 (2022) «En finir avec les disparitions forcées sur le territoire du Conseil de l'Europe» et souligne l'importance primordiale pour les droits humains et l'État de droit de donner un nouveau souffle aux efforts internationaux visant à en finir avec les disparitions forcées en Europe et ailleurs dans le monde.
2. À cette fin, l'Assemblée recommande au Comité des Ministres:

2.1. de promouvoir la ratification de la Convention internationale pour la protection de toutes les personnes contre les disparitions forcées (International Convention for the Protection of All Persons from Enforced Disappearance, ICPPED) des Nations Unies par tous les États membres du Conseil de l'Europe et la reconnaissance de toutes les compétences du Comité des disparitions forcées ainsi que l'intégration dans le droit national de toutes les mesures préventives et répressives préconisées par l'ICPPED;

2.2. d'offrir, avec la coopération des États déjà parties à l'ICPPED, une assistance technique à tous les États intéressés pour les aider à mettre en oeuvre l'ICPPED, sur la base d'une analyse approfondie de la législation existante des États concernés;

2.3. de créer, au sein du Conseil de l'Europe, un groupe de travail spécialisé («task force») sur les disparitions forcées, chargé de coordonner les activités évoquées ci-dessus et de suivre le progrès de la protection juridique contre ce crime dans les États membres du Conseil de l'Europe, et de promouvoir une meilleure prévention, avec la participation de la société civile;

2.4. d'accorder une attention particulière à l'exécution des arrêts de la Cour européenne des droits de l'homme concernant des cas de disparition forcée, ainsi qu'à la mise en oeuvre des mesures provisoires pertinentes indiquées par la Cour européenne des droits de l'homme;

2.5. d'encourager les États membres à imposer des sanctions aux organes étatiques, aux groupes contrôlés par un État et aux individus impliqués dans les affaires de disparitions forcées sur les territoires des États membres du Conseil de l'Europe ou qui entravent des enquêtes effectives sur ces affaires;

2.6. de soutenir l'idée d'une conférence mondiale sur le thème des disparitions forcées, qui donnera aussi aux États l'occasion d'annoncer de nouvelles ratifications de l'ICPPED.

Porre fine alle sparizioni forzate sul territorio del Consiglio d'Europa

Assemblea parlamentare

1. L'Assemblea parlamentare rimanda alla sua Risoluzione 2425 (2022), "Porre fine alle sparizioni forzate sul territorio del Consiglio d'Europa", e sottolinea l'importanza determinante, per i diritti umani e lo stato di diritto, di dare nuovo impulso all'impegno internazionale per porre fine alle sparizioni forzate in Europa e nel resto del mondo.
2. Prefiggendosi tale obiettivo, l'Assemblea raccomanda al Comitato dei Ministri di:

2.1 promuovere la ratifica della Convenzione internazionale per la protezione di tutte le persone dalla sparizione forzata (CED) da parte di tutti gli Stati membri del Consiglio d'Europa e il riconoscimento della piena competenza del Comitato sulle sparizioni forzate, nonché il recepimento nella legislazione nazionale di tutte le misure preventive e repressive previste dalla CED;

2.2 fornire assistenza tecnica, con la cooperazione degli Stati che sono già parti alla CED, a tutti gli Stati interessati per aiutarli ad attuare tale convenzione, sulla base di un'analisi approfondita della legislazione esistente negli Stati in questione;

2.3 istituire, in seno al Consiglio d'Europa, una task force sulle sparizioni forzate incaricata di coordinare le attività di cui sopra e di monitorare i progressi della protezione giuridica da questo crimine negli Stati membri del Consiglio d'Europa, nonché di promuovere una migliore prevenzione con il coinvolgimento della società civile;

2.4 porre un accento particolare sull'esecuzione delle sentenze della Corte europea dei diritti dell'uomo relative ai casi di sparizione forzata, nonché sull'attuazione delle misure provvisorie pertinenti indicate dalla Corte europea dei diritti dell'uomo;

2.5 incoraggiare gli Stati membri a imporre sanzioni contro gli organi di Stato, i gruppi controllati dallo Stato e i singoli individui coinvolti nei casi di sparizioni forzate nei territori degli Stati membri del Consiglio d'Europa o che ostacolano indagini efficaci su questi casi;

2.6 sostenere l'idea di organizzare una conferenza mondiale sul tema delle sparizioni forzate, che darebbe inoltre agli Stati l'occasione di annunciare nuove ratifiche della CED.
