How to put confiscated criminal assets to good use?

Parliamentary Assembly

1. The Parliamentary Assembly refers to its Resolution 2434 (2022) and reaffirms its full and wholehearted support for fighting organised crime and corruption, including through the systematic confiscation of assets of illegal origin.
2. It refers to its previous work aimed at facilitating the confiscation of illegal assets by authorising their confiscation without prior conviction and by reversing the burden of proof, with adequate safeguards (Resolution 2218 (2018)), as well as by strengthening financial intelligence units and intensifying international co-operation (Resolution 2279 (2019) and Resolution 2365 (2021)).
3. It also recalls the important work accomplished in this sense by the Group of States against Corruption (GRECO) and the Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism (MONEYVAL) and stresses the importance of the Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime (ETS No. 141) and the Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism (CETS No. 198).
4. As a follow-up to this work, the Assembly invites the Committee of Ministers to consider preparing a recommendation to member States aimed at promoting the social reuse of confiscated illegal assets.
5. It considers that having a recommendation based on an in-depthstudy of the best practicesalready put in place by several member States would send a powerful signal to the communities affected by criminal and corrupt practices that crime does not pay and that the rule of law is capable of defending them by using those ill-gotten gains to fight crime and repair the damage it does.

1. L'Assemblée parlementaire se réfère à sa Résolution 2434 (2022) et réitère son soutien plein et entier à la lutte contre le crime organisé et la corruption, notamment par la confiscation systématique des avoirs d'origine illicite.
2. Elle rappelle ses travaux antérieurs visant à faciliter la confiscation des avoirs d'origine illicite par l'autorisation de leur confiscation sans condamnation préalable et par le renversement de la charge de la preuve, assortis de garanties adéquates (Résolution 2218 (2018)), ainsi que par le renforcement des cellules de renseignement financier et l'intensification de la coopération internationale (Résolution 2279 (2019) et Résolution 2365 (2021)).
3. Elle rappelle également les travaux importants accomplis dans ce sens par le Groupe d'États contre la corruption (GRECO) et le Comité d'experts sur l'évaluation des mesures de lutte contre le blanchiment des capitaux et le financement du terrorisme (MONEYVAL), et souligne l'importance de la Convention relative au blanchiment, au dépistage, à la saisie et à la confiscation des produits du crime (STE no 141) et de la Convention du Conseil de l'Europe relative au blanchiment, au dépistage, à la saisie et à la confiscation des produits du crime et au financement du terrorisme (STCE n. 198).
4. Dans le prolongement de ces travaux, l'Assemblée invite le Comité des Ministres à envisager la préparation d'une recommandation aux États membres visant à promouvoir la réutilisation sociale des avoirs illicites confisqués.
5. Elle considère qu'une telle recommandation, fondée sur une étude approfondie des bonnes pratiques déjà mises en œuvre dans plusieurs États membres, enverrait aux populations victimes des pratiques criminelles et corrompues un signal fort, à savoir que le crime ne paie pas et que l'État de droit est capable de les défendre en utilisant l'argent du crime pour combattre le crime et réparer les dégâts qu'il cause.

Come fare un buon uso dei beni confiscati di origine criminale?

Assemblea parlamentare

1. L'Assemblea parlamentare fa riferimento alla Risoluzione 2434 (2022) e reitera il suo pieno e completo sostegno alla lotta alla criminalità organizzata e alla corruzione, in particolare attraverso la confisca sistematica di beni di origine illecita.
2. Ricorda i propri precedenti lavori tesi a facilitare la confisca di beni illeciti attraverso l'autorizzazione alla confisca senza condanna e con inversione dell'onere della prova, accompagnata da tutele adeguate (Risoluzione 2218 (2018)), nonché il rafforzamento delle unità di intelligence finanziaria e l'intensificazione della cooperazione internazionale (Risoluzione 2279 (2019) e Risoluzione 2365 (2021)).
3. Richiama altresì gli importanti lavori svolti in tal senso dal Gruppo di Stati contro la Corruzione (GRECO) e dal Comitato di esperti per la valutazione delle misure contro il riciclaggio di denaro e il finanziamento del terrorismo (MONEYVAL) e sottolinea l'importanza della Convenzione sul riciclaggio, la ricerca, il sequestro e la confisca dei proventi di reato (STE n. 141) e la Convenzione del Consiglio d'Europa sul riciclaggio, la ricerca, il sequestro e la confisca dei proventi di reato e sul finanziamento del terrorismo (STCE n. 198).
4. Nel prosieguo di questi lavori, l'Assemblea invita il Comitato dei Ministri a considerare l'opportunità di preparare una raccomandazione agli Stati membri tesa a promuovere il riutilizzo a fini sociali dei beni illeciti confiscati.
5. Ritiene che una tale raccomandazione, basata su uno studio approfondito delle buone prassi già attuate da diversi Stati membri, invierebbe alle popolazioni vittime di pratiche criminali e della corruzione, il forte segnale che il crimine non paga e che lo Stato di diritto è in grado di difenderli, utilizzando i proventi del crimine per combattere la criminalità e riparare i danni da questa causati.
